Terms of Service

These terms are an agreement between you and Cartoon Baseball (“we”, “us”), a trade name of DavidPM, LLC, the publisher of Chart Topper, covering the Chart Topper iOS game and the chart-topper.com websites. By playing, you accept them. Apple's standard Licensed Application End User License Agreement also applies to the app; where these terms grant you more, these terms control. Apple is not responsible for the game and has no obligation to support it, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Who can play

You must be at least 13 years old (or the higher minimum digital-consent age in your country). One account per person; you're responsible for activity on your account.

Your license

We grant you a personal, non-transferable, revocable license to play Chart Topper on Apple-branded devices you own or control. Don't copy, resell, reverse engineer, or exploit the game or its content outside normal play.

A live, shared game

Chart Topper is a live service played against other people on shared game weeks and seasons. Charts, revenue pools, balance values, features, and content change over time, including changes that affect your standing, items, or strategies, and seasons end and reset by design. We may modify, suspend, or discontinue any part of the game. Game state is server-authoritative; what our servers record is the game of record.

Virtual items and currency

Gems, in-game money, cards, cosmetics, and other virtual items are licensed to you, not sold. They have no real-world value, can't be transferred, sold, or redeemed for money, and may be rebalanced or retired as the game evolves. Purchases (gems, ad removal) are processed by Apple; billing issues and refund requests go through Apple.

Fair play

No cheating: no automation, exploits, tampering with the client or traffic, multiple accounts used to manipulate charts or pools, or interference with other players' experience. Spending never buys competitive advantage in Chart Topper, and attempting to manufacture one is grounds for score resets, forfeiture of virtual items, or account termination.

Your content

You create content in the game: an artist name, song titles, lyrics, song clips, artwork, feed posts. You keep whatever rights you have in it. Be aware that content made by AI often has no copyright at all, in the US and in many other countries, which means in a lot of cases neither you nor we own it. See “AI-generated content” below.

You grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, publicly perform, and stream that content in order to operate and promote the game. That covers the in-game community, the public charts and winners board at chart-topper.com, content you share or export from the app, and Chart Topper Radio. This license ends for a piece of content when you remove it or delete your account, with two exceptions: copies other people already made are outside our reach, and anonymized chart records stay as described in the privacy policy.

Content rules: no slurs, hate speech, or harassment; no hard profanity or sexually explicit wording; nothing unlawful; nothing that infringes someone else's rights (including impersonating a real artist or using their name or work); nothing that targets private individuals.

Music gets dark, and that's fine. Heartbreak, anger, addiction and what it costs, and violence in a story are normal songwriting territory and are not against the rules. What we screen out is different: content that encourages, glorifies, or gives instructions for suicide, self-harm, or disordered eating. A song can be about pain without being an instruction manual. This applies to what you write and to what you ask the AI to write.

Names, titles, and prompts are screened automatically when you submit them (on your device where possible; see the privacy policy) and may be rejected. We may also rename, remove, or restrict content that breaks these rules after it's live, and repeated or serious violations end accounts. Players can report content in-game; reports are reviewed.

Copyright and takedowns

If you believe something in Chart Topper or on our sites infringes your copyright, tell us and we will act on it.

Your notice needs to include: your signature (electronic is fine), what work you say was infringed, where the infringing material is (a link to the song page, artist page, or feed post), how to reach you, a statement that you believe in good faith the use is not authorized, and a statement that the information in your notice is accurate and that you are the rights holder or authorized to act for them.

We remove or disable material that is the subject of a valid notice, and we tell the player what happened. If you are that player and you think the removal was a mistake, you can send us a counter-notice with your signature, the material and where it was, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, your contact details, and your consent to the jurisdiction of the federal court for your address.

We end the accounts of players who repeatedly infringe. We count a strike when we remove content following a valid notice that is not successfully countered. Three strikes ends the account, and we may act sooner for a single serious or deliberate case. Ending an account for this reason forfeits virtual items and progress and does not entitle you to a refund.

Knowingly filing a false notice or counter-notice carries liability under 17 U.S.C. 512(f).

AI-generated content

Some in-game content is generated by third-party AI models from your prompts, including text, images, and short music clips with synthesized vocals. Outputs are provided as-is: they may be imperfect and similar outputs may be generated for other players. Your prompts must follow the content rules above, and we may filter or refuse prompts. To the extent we hold rights in generated outputs, we assign them to you for use within and outside the game, subject to the license you grant us above and to the AI provider's terms.

AI song clips are entertainment features provided for amusement within the game. They are not production or commercial music: the singing voice is synthetic and does not belong to any real person, we make no promises about a clip's originality, quality, or fitness for release outside the game, and generated audio may carry an inaudible identifier (such as Google's SynthID watermark) marking it as AI-made. Clips never affect charts, revenue, or any player's competitive standing.

You can download a copy of a song clip to your device, which may cost gems. A download is your copy of the clip to keep and enjoy; it does not change anything said above. It is not a commercial release or production music, we make no promises about its originality or fitness for any use outside the game, and the inaudible AI identifier stays in the file. If you post a downloaded clip somewhere else, following that platform's rules, including any requirement to disclose AI-made audio, is on you.

Chart Topper Radio

Chart Topper Radio plays song clips on chart-topper.com, where anyone can listen without an account or the app. There is a radio inside the game too. The two play different things: the in-game radio plays released songs from across the game, which are already public in-game on the charts and their own pages, and the radio on chart-topper.com plays only songs you have shared to the web yourself.

Nothing reaches the public radio because it charted or because you played well. Only sharing puts it there. If you unshare a song or take your artist page down, it stops being eligible and comes out of rotation.

Listening pays. When someone hears at least half of one of your clips it counts as a listen, and listens rank you for a share of the Airplay pool at the next Payday. Songs that have moved to your back catalog keep playing but stop earning. Because real money in the game rides on this, listens are subject to the same fair play rules as everything else: do not use scripts, bots, repeated automated plays, or coordinated groups to inflate your own listens or anyone else's. We discount listens that look manufactured, and manufacturing them is grounds for score resets, forfeiture of virtual items, or account termination.

Radio play is a feature of the game, not a distribution deal. It does not make your clip a commercial release, does not generate real royalties, and does not register anything with any rights organization. Nothing about a clip appearing on the radio changes what is said above under “AI-generated content”.

Termination

You can stop playing or delete your account at any time (Settings → Delete Account). We may suspend or terminate accounts that violate these terms or harm the service or its players. Accounts may also end under the repeat infringer policy in “Copyright and takedowns” above. Virtual items and progress are not compensable on termination or when a season ends.

Disclaimers and limits

The game is provided “as is” and “as available,” without warranties of any kind to the maximum extent the law allows. To the same extent, our total liability for any claim relating to the game is limited to the greater of $100 or the amount you paid us in the 12 months before the claim, and we're not liable for indirect, incidental, or consequential damages. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that can't lawfully be limited.

Changes to these terms

If we materially change these terms, we'll update the date above and give notice in-game or on this site before the changes take effect. Continuing to play after that is acceptance.

Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Washington, and you and we consent to their jurisdiction, unless applicable law gives you a mandatory alternative.
