Terms of Service

These terms are an agreement between you and DavidPM, LLC (“we”, “us”), the publisher of Chart Topper, covering the Chart Topper iOS game and the chart-topper.com websites. By playing, you accept them. Apple's standard Licensed Application End User License Agreement also applies to the app; where these terms grant you more, these terms control. Apple is not responsible for the game and has no obligation to support it, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Who can play
You must be at least 13 years old (or the higher minimum digital-consent age in your country). One account per person; you're responsible for activity on your account.
Your license
We grant you a personal, non-transferable, revocable license to play Chart Topper on Apple-branded devices you own or control. Don't copy, resell, reverse engineer, or exploit the game or its content outside normal play.
A live, shared game
Chart Topper is a live service played against other people on shared game weeks and seasons. Charts, revenue pools, balance values, features, and content change over time, including changes that affect your standing, items, or strategies, and seasons end and reset by design. We may modify, suspend, or discontinue any part of the game. Game state is server-authoritative; what our servers record is the game of record.
Virtual items and currency
Gems, in-game money, cards, cosmetics, and other virtual items are licensed to you, not sold. They have no real-world value, can't be transferred, sold, or redeemed for money, and may be rebalanced or retired as the game evolves. Purchases (gems, ad removal, paid season entry) are processed by Apple; billing issues and refund requests go through Apple. Paid season entry buys access to that season only, placement and rewards depend on play.
Fair play
No cheating: no automation, exploits, tampering with the client or traffic, multiple accounts used to manipulate charts or pools, or interference with other players' experience. Spending never buys competitive advantage in Chart Topper, and attempting to manufacture one is grounds for score resets, forfeiture of virtual items, or account termination.
Your content
You create content in the game: an artist name, song titles, lyrics, artwork, feed posts. You keep your rights to it. You grant us a worldwide, royalty-free license to host, display, and reproduce that content to operate and promote the game, including in the in-game community, on the public charts and winners board at chart-topper.com, and in shared/exported content generated by the app.
Content rules: nothing unlawful, hateful, sexually explicit, or harassing; nothing that infringes someone else's rights (including impersonating a real artist or using their name or work); nothing that targets private individuals. We may rename, remove, or restrict content that breaks these rules, and repeated or serious violations end accounts. Players can report content in-game; reports are reviewed.
AI-generated content
Some in-game content is generated by third-party AI models from your prompts. Outputs are provided as-is: they may be imperfect and similar outputs may be generated for other players. Your prompts must follow the content rules above, and we may filter or refuse prompts. To the extent we hold rights in generated outputs, we assign them to you for use within and outside the game, subject to the license you grant us above and to the AI provider's terms.
Sponsored content
The game's community feed may include clearly labeled promotional placements from real-world artists and music partners. Sponsored placements are content only, and they never affect charts, revenue pools, or any player's competitive standing.
Termination
You can stop playing or delete your account at any time (Settings → Delete Account). We may suspend or terminate accounts that violate these terms or harm the service or its players. Virtual items and progress are not compensable on termination or when a season ends.
Disclaimers and limits
The game is provided “as is” and “as available,” without warranties of any kind to the maximum extent the law allows. To the same extent, our total liability for any claim relating to the game is limited to the greater of $100 or the amount you paid us in the 12 months before the claim, and we're not liable for indirect, incidental, or consequential damages. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that can't lawfully be limited.
Changes to these terms
If we materially change these terms, we'll update the date above and give notice in-game or on this site before the changes take effect. Continuing to play after that is acceptance.
Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Washington, and you and we consent to their jurisdiction, unless applicable law gives you a mandatory alternative.
